Probate Applications

We can assist clients with applying for probate, formally known as an Application for a Certificate of Appointment of Estate Trustee With or Without a Will (previously referred to as “letters probate” if there is a Will and “letters of administration” if there is no Will). Probate is a formal process of applying to the Court to either give a person the authority to act as the estate trustee (sometimes referred to as the “executor” or “estate administrator”), confirm that the trustee named in a Will has the authority to act, or to approve the Will as the valid last Will of the deceased. Probate is not always required, but when it is, the issue of estate administration tax (commonly referred to as “probate fees” or “probate tax”) will have to be addressed. In some instances, trustees only require assistance in preparing and submitting the Application for a Certificate of Appointment of Estate Trustee but not the actual administration of the estate.
